For almost 10 years in total I have been extremely patient with this assault on my hard earned reputation – out of supreme respect for due process, from the unshakable confidence that the truth will ultimately prevail and from a deep sense of destiny of being charged with a sacred mission from the Universe. But that reticence is over. I make these opening statements now in a new, injustice-invigorated pursuit of full public disclosure, in my full rights under the Canadian Charter of Rights and Freedoms.
I say now to the monsters that handled this misapplication: Funmi’s forerunning fury is justified for this reason: your whole-sale deception of the public by these claims. Because no one who reads these claims, secure in their de facto trust in the structures and procedures of the College would ever guess:
1. That you had absolutely no proof of what you claim against my name. That in this day and age of digital technology you have not a shred of evidence that substantiates these destructive and egregious claims. Recently when I brought an urgent motion before the Ontario Human Right Tribunal which demanded that you produce evidence for these claims before the Tribunal your response was to lawyer up and submit that you are immune from such requests.
2. That the lady you exploited for this hatchet job was a deeply troubled, drug and alcohol-addicted, black, call girl with the ‘perfect’, long, legal record of instigating trouble for others, as her own mother once told a College investigator.
Nor that her exploitative manipulation by her College handlers began 5 years after she first called the College then immediately distanced herself from her action until you, for unrelated reasons pursued and compelled her to serve as your witness. Nor that she demonstrated through out her ensuing ordeal with her College handlers a floridly erratic and unreliable conduct that seemed almost designed to signal that she was acting under duress. Nor that this was actually more than 5 years after I had discontinued even my walk-in therapeutic alliance with her. For the record Shantel, you had better be ready for my lawsuit against you, if you get to read this. You can not hide anymore, you need to dance to the music you played!
3. That your claim of record deletion was a horrendous, schizophrenic level fabrication. NO RECORDS WERE EVER DELETED before or after case onset and as my office staff will bear witness to I do not even inform them of impending investigators visit (there was absolutely nothing to hide) so investigators could get an unbiased and undeviated response from them.
4 That your claim of the obstruction of investigation never had a shred of evidence presented in support of it. And that nothing of my statement given from the onset and through out ever deviated from the self evidence of the extant case records.
5. That you ignored your own rules as it fits you, in order to enforce subjective narratives that fit your plan to destroy an arrogant Nigerian physician.
Case handlers made bold to preclude the public disclosure of essential points of this case by the muzzle of a media ban at the end of the Disciplinary Committee’s Salem witch trial. That muzzle is now off.
Do not be deluded: this is not a disdain for the sacred stature of the College, but of the malicious actions wrought by the specific individuals in charge, under the aegis of the College. This is a diatribe against heavy-handedness against physicians in the name of remediation. For remediation should be this: the fair and proper abnegation of valid and validated malfeasances in the physician-patient relationship. There are monsters everywhere. But remediation is not the vindictive manipulation of day-clear facts in service
of the punishment of a rude and arrogant physician, a self-proclaiming conclusion not mine. For nothing else explains this extreme degree of misapplication of the College’s powers and resources.
Nor does this in any way suppose a jaundiced view of all College personnel. Never. I have had some of the most amazing interactions with College officials – be it the investigators of my office cases, or of other physicians reaching me for witnessing, or of congenial College customer service personnel. We have had laughs, shared compliments, and sheer good-natured courtesy. There are good people everywhere.
Therefore, I do this now on behalf of all the good doctors working hard out there, who are being similarly traumatized, living and working in constant fear, their care delivery distracted by the heavy-booted foot of ill-intentioned College regulators, like Sword of Damocles, ever at their necks. In the hope that in some small way, this will somehow count towards all our better protection.
If by your actions and decisions you prove yourselves wilfully blind to the fact that we all come to these common lands from very diverse backgrounds and cultural sensibilities then you prove yourselves anachronistic to the great multicultural experiment that is Canada. To take my ingrained values of community, compassion and candor and demonize them into this twisted medieval travesty is to be in all final analysis an enemy of the Canadian state.
And the end of the matter is this. Stopping a practice with thousands of well-cared-for hospital and community patients: workers, elders, children, students, the physically impaired etc who depend on it for their vital health care needs should only be when a physician is dangerously out of control, not because a deeply troubled, social outcast once besmeared him or her with chronically overactive and dishonest imagination. That is deeply irresponsible. And the College’s responsibility here should be to weed out its monsters, not allow them to hide behind well-intentioned legal provisions. Not to do so is to risk subverting the CPSO into Monsters Incorporated.
